OFER EXPRESS’ CARGO LIABILITY DECLARATION

FULL OR LESS THAN TRUCKLOAD SHIPMENTS:

OFER EXPRESS HAS ZERO LIABILITY FOR ANY SHIPMENT IN CASE OF DAMAGE, LOSS, SHORTFALL OR LATE DELIVERY.  Ofer Express LLC. is a broker not a carrier and is therefore not liable for loss or damage from shipments because amongst other reasons we do not actually handle the goods.  This is reflected in the fact that there are no Title 49 requirements for brokers to have Cargo Insurance in Federal Law.  If Ofer Express elects to help a Claimant file a claim against a Carrier this does not imply Ofer Express has any liability for that shipment.  Ofer Express simply arranges a carrier who represents that they can fulfill your shipping requirements to pick up at Point A and deliver to Point B and that is it – if you the shipper or potential Claimant have insurance needs you must specify them in writing at least 24 hours prior to pickup to Ofer Express’s fax.  Otherwise in all matters of insurance, cargo liability or shipment liability ONLY the terms of the pickup carrier’s tariff or quote apply to the shipment in case of shortage, damage or loss.  Carrier and Ofer Express are under no obligation to advise shipper or Freight Payee or Claimant of any limits of liability: the shipper is responsible for ensuring he has adequate insurance for the shipment and should advise in writing to Ofer Express 24-hours in advance of the shipment pickup time if they need Ofer Express to obtain certain insurance coverage for their shipment.  In any case, Ofer Express has no actual, real and/or implied liability on any shipment.
